what it covers

Mapping a project’s approvals path.

Four tenure regimes, the assessment triggers that attach to each, utility and water permits, holding structure, and the instruments that give a review process force. Six sub-modules, ending in an approvals map for your own land base and a scoping brief for counsel. A data centre is not a designated project federally, and provincial assessment does not reach reserve land.

01

Identify the tenure regime

The land base placed in one of four regimes, with the development constraints and law-making powers it carries.

02

Determine the assessment triggers

Which environmental and building approvals a described project attracts, and which reach it at all.

03

List the permits and their holders

Each permit a project requires, the party holding it, and which of them are open to challenge.

04

Match objective to instrument

A governance aim paired with the law, by-law or agreement capable of carrying it.

the sub-modules

Sub-modules.

Each one stands alone: a cold open on a real document, five to eight minutes of teaching, one activity on your own material, and five graded items.

Tenure regimes and development authority

Indian Act reserve land, land codes under the Framework Agreement, the commercial and industrial route, and modern treaty settlement lands.

Tenure regimes and development authority

Indian Act reserve land, land codes under the Framework Agreement, the commercial and industrial route, and modern treaty settlement lands.

Assessment triggers and regulatory gaps

Which environmental and building approvals a described project triggers, and which reach it at all.

Interconnection and water licensing

Every permit a project requires, the party holding each, and which are open to challenge.

continued

Sub-modules, continued.

The last three sub-modules cover the holding structure, the review process itself, and how to brief counsel on it.

The module artifact

An Approvals Path Map for the learner’s own land base, and a Legal Scoping Brief to go with it.

the take away

What the learner keeps.

Every sub-module ends in a downloadable written to be usable by someone who has not taken the course.

Approvals map

Every approval a project on the learner’s own land base would need, in the order it would need them.

Scoping brief

What to ask counsel for, what to expect it to cost, and how to tell whether the advice answers the question.

Module credential

Sub-modules are individually completable and individually badged, and all ten modules make the credential.
